Introduction of invoice under GST

GST invoice is a commercial instrument that is required to be issued by a supplier of both goods and services to a recipient of the supply. There is no particular format for GST Invoice, but it generally shows the particulars of the parties involved, the description of goods sold or services supplied, the quantifies the items sold, also shows the date of goods or service supplied and mode of transportation (if any), prices and discounts, if any, and the delivery address, if different than recipient’s address.

Invoicing is a very crucial aspect for ensuring tax compliance under the new GST taxation system. In the case of the supply of goods or provision of services, an invoice is raised by the supplier of such goods or services to the recipient of the supply.

In the new GST regime, if one fails to adhere to all the compliances, the taxpayer will have to incur fines and penalties.

Statutory Provision related to GST Invoice

The provisions relating to GST invoices are provided under section 31 of the CGST Act, 2017 as well as under Chapter-VI: Tax Invoice, Credit and Debit Notes of Central Goods and Services (CGST) Rules, 2017. The provisions contained in the above rules have been incorporated at the relevant places.

The Government has also set a time limit within which registered persons shall have to issue the GST invoice for supplies made by them. The time for issuing an invoice would depend on the nature of supply, whether it is a supply of goods or a supply of services. In case of supply involving movement of goods, the invoice should be issued before or at the time of removal of goods. In case supply does not involve movement of goods, the invoice must be raised before or at the time of delivery of supply.

In case of a registered person supplying taxable services, the tax invoice should be issued – at least before or after the provision of services, but within the specified period of 30 days (45 days – in case of Banking/Financial Institutions including Non-Banking Financial Company - NBFC).

Format of GST Invoice and Mandatory fields

As per section 31 of the CGST Act, 2017 and rules made thereunder, there is no format prescribed for GST invoice, but as per Chapter-VI: Tax Invoice, Credit and Debit Notes of Central Goods and Services (CGST) Rules, 2017 make it mandatory for an invoice to have the following fields.

  • Name of the supplier
  • Address of the supplier
  • GSTIN of the supplier
  • Date of issue of Invoice
  • HSN/SAC code for goods or services as the case may be
  • Description of goods or services as the case may be
  • In case of goods, the quantity, and unit or Unique Quantity Code of goods
  • Total value of supply of goods or services as the case may be
  • Taxable value of supply of goods or services as the case may be
  • Rate of tax (whether it be a central tax, State tax, integrated tax, Union territory tax or cess, etc.)
  • Amount of tax charged separately in respect of taxable goods or services or both (Central tax, State tax, integrated tax, Union territory tax or cess as the case may be)
  • Signature or digital signature as the case may be of the supplier or his authorized representative (Signature or digital signature is not required in case of issuance of an electronic invoice in accordance with the provisions of the Information Technology (IT) Act, 2000)
  • QR Code - Quick Response code, having Invoice Reference Number (IRN) in it, in case e-invoice has been issued (provided that QR Code may only have details which are on the original invoice and not extra than the GST invoice).

Few important points to keep in mind regarding GST invoices

In case of a supply in the course of inter-state trade or commerce, place of supply along with the name of State in which supply is being made has to be mentioned in the GST Invoice.

In case the recipient is unregistered, and the value of supply is more than Rs. 50,000 then name and address of the recipient along with the address of delivery should be mentioned.

In case of taxable supply of goods, GST invoice should be prepared in triplicate. The original copy is to be given to the Recipient of supply, the Duplicate copy is to be given to the Transporter (if any) and the Triplicate copy is to be kept by the Supplier.

In case of taxable supply of service, GST invoice should be prepared in duplicate. The original copy is to be given to the recipient of supply and the driplicate copy is to be kept by the supplier.

All registered persons under the GST Act can design their own GST Invoice Format. However, the law requires that only certain fields are mandatory fields in the GST Invoice.

Penalty for non-compliance under GST

Penalty for non-issuance of GST invoice is 100% of the tax due or Rs.10,000, whichever is higher. The penalty for incorrect invoicing is Rs.25,000.
